Video System Warranty

QMI VIDEO TRAINING SYSTEM LIMITED WARRANTY & Courtesy Replacement

Please inspect all Components of the QMI Video System Immediately upon Delivery. Replacement Policy is Limited to 30 (thirty) Days from Receipt of Delivery.

A. Limited Warranty on Defective Component. The seller, Quality Methods International Inc. (“QMI”), will replace any significantly defected component (“Defective Component”) of the Visual Workplace-Visual Order Video Training System (“QMI VIDEO SYSTEM”) under the following conditions (see section C for Courtesy Replacement):

  1. BUYER must report its claim of a Defective Component to QMI in writing within thirty (30) days from the date that the QMI VIDEO SYSTEM is delivered to the BUYER’s shipping address.
  2. BUYER must return the Defective Component to QMI by traceable mail at the BUYER’s expense.
  3. BUYER must include a proof of purchase receipt with the return of Defective Component.
  4. In the event that the QMI Video System is shipped outside the United States and could be damaged in the process of custom inspection or related processes, QMI may, at its option, request that the BUYER provide proof showing that the component was defective upon leaving QMI offices and not due to any ordinary course of events related to the shipment process; if QMI so requires, BUYER will submit such proof and any related information in English.

If QMI determines the BUYER’S claim is valid, then QMI will ship a replacement component “Replacement Component”), at QMI’s expense, within thirty (30) days of such determination.

To the extent allowed by applicable law, implied warranties on the QMI VIDEO SYSTEM, if any, are limited to thirty (30) days. This LIMITED WARRANTY is void if failure of Defective Component has resulted from accident, abuse, or misapplication. Any Replacement Component shall receive a 30-day warranty, under the following conditions:

  1. BUYER must report its claim of a defective Replacement Component to QMI in writing within thirty (30) days from the date that the Replacement Component is delivered to the BUYER’s shipping address.
  2. BUYER must return the Replacement Component to QMI by traceable mail at the BUYER’s expense.
  3. BUYER must include a proof of purchase receipt with the return of Replacement Component.

QMI will not refund any shipping, customs or tariffs charges, associated with the sale or return of any Defective Component or Replacement Component of the QMI VIDEO SYSTEM.

B. Customer Remedy. QMI’s entire liability and BUYER’s exclusive remedy shall be:

  1. Replacement of any component of the QMI VIDEO SYSTEM which does not meet QMI’s limited warranty and which is returned to QMI as set forth above.

C. Courtesy Replacement for Accidentally-Damaged CD, DVD or Tape. QMI will replace a CD, DVD or VHS/PAL Tape component of the QMI VIDEO SYSTEM if such CD, DVD or Tape is accidentally damaged by BUYER and returned to QMI, with the BUYER pre-paying all associated shipping costs. Please allow ten business days for QMI processing. This Courtesy Replacement is limited to one replaced CD, DVD, or Video Tape per BUYER; any replacement beyond this will be at QMI’s sole discretion.

D. NO OTHER WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QMI DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE QMI VIDEO SYSTEM. THIS LIMITED WARRANTY GIVES BUYER SPECIFIC LEGAL RIGHTS.

E. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QMI BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE QMI VIDEO SYSTEM, OR ARISING OUT OF ANY BREACH OF THE WARRANTY, EVEN IF QMI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, QMI’S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS WARRANTY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY BUYER FOR THE QMI VIDEO SYSTEM.

F. JURISDICTION AND APPLICABLE LAW. ANY ACTION INITIATED REGARDING THIS WARRANTY SHALL BE INITIATED IN THE CIRCUIT COURT FOR THE STATE OF OREGON FOR THE COUNTY OF MULTNOMAH. THIS WARRANTY SHALL BE INTERPRETED UNDER THE LAWS OF THE STATE OF OREGON.
